1. Introduction
Welcome to Chowpadi. These Terms of Service ("Terms") govern your use of the Chowpadi platform — including our website and WhatsApp-based ordering service — operated by Chowpadi Limited, a company registered in Nigeria ("Chowpadi", "we", "us", or "our").
By using our Service — including placing your first order — you confirm that you have read, understood, and agreed to these Terms together with our Privacy Policy. If you do not agree, please do not use the Service.
These Terms are governed by the laws of the Federal Republic of Nigeria.
2. What Chowpadi Does
Chowpadi is a food ordering platform that connects customers with restaurant partners across Nigeria. Our service allows you to:
- Browse restaurant menus and place food orders via WhatsApp or our website
- Pay for orders securely through Paystack
- Track your order and receive updates via WhatsApp
- Receive follow-up messages and loyalty offers from restaurants you have ordered from
Chowpadi acts as an intermediary between you and restaurant partners. We are responsible for the ordering experience, payment processing, and communication. The preparation and quality of food is the responsibility of the individual restaurant.
3. Your Account
When you first message a Chowpadi WhatsApp Business number, an account is automatically created for you using your WhatsApp phone number. You are responsible for:
- Ensuring your WhatsApp account details are accurate and up to date
- Keeping your account secure and not sharing access with others
- All activity that occurs through your account
You must be at least 13 years old to use our Service. By using Chowpadi, you confirm that you meet this requirement.
We reserve the right to suspend or terminate accounts that violate these Terms or are used in a manner that is harmful to other users, restaurant partners, or the platform.
4. Placing Orders
a) Order Placement
Orders are placed through our WhatsApp-based AI ordering assistant or our website. Once you confirm an order, it is sent to the restaurant for preparation. You are responsible for reviewing your order details — including items, quantities, and delivery address — before confirming.
b) Order Acceptance
Once you submit an order, it is processed by our system and forwarded to the restaurant. We will make reasonable efforts to send you a confirmation via WhatsApp, however confirmation delivery may occasionally be delayed due to network conditions beyond our control. You can always contact us at support@chowpadi.com to verify the status of your order. We and our restaurant partners reserve the right to decline or cancel orders due to unavailability of items, operational issues, or other circumstances, in which case you will be notified promptly.
c) Accuracy of Information
You are responsible for providing accurate delivery information. Chowpadi and our restaurant partners are not liable for failed or delayed deliveries resulting from incorrect addresses or contact details provided by you.
d) Order Modifications & Cancellations
Once an order has been accepted and preparation has begun, modifications or cancellations may not be possible. If you need to cancel or modify an order, contact us immediately at support@chowpadi.com and we will do our best to assist, though we cannot guarantee changes once preparation is underway.
5. Payments
a) Payment Processing
All payments are processed securely through Paystack. All card entry occurs directly on Paystack's secure payment page. Chowpadi does not handle or store your card number, CVV, or PIN at any point.
b) Saved Card Authorisation
After a successful payment, Paystack provides Chowpadi with a secure card authorisation token. This allows us to process future payments on your behalf without you needing to re-enter your card details for each order. This token cannot be used to retrieve your actual card information. You may request removal of a saved authorisation at any time by contacting support@chowpadi.com.
c) Cash on Delivery
Where cash on delivery is available, payment is made directly to the delivery rider upon receipt of your order. Ensure you have the exact amount ready where possible.
d) Pricing
Prices displayed are set by restaurant partners and may change without prior notice. Delivery fees, where applicable, will be clearly communicated before you confirm your order. All prices are in Nigerian Naira (₦).
e) Refunds
Refunds are considered on a case-by-case basis. If you receive an incorrect, incomplete, or unsatisfactory order, please contact us at support@chowpadi.com within 24 hours of delivery. We will review the complaint and, where appropriate, process a refund or offer a remedy. Approved refunds are credited to your Chowpadi wallet and may only be used for food orders on the Chowpadi platform.
6. Delivery
Chowpadi coordinates delivery through our network of riders. Delivery times are estimates and may vary depending on distance, traffic, weather, and restaurant preparation time. We will keep you informed of your order status via WhatsApp.
Chowpadi is not liable for delays caused by circumstances beyond our reasonable control, including but not limited to adverse weather, road conditions, or inaccurate delivery information provided by you.
Upon delivery, you or an authorised recipient must be available to receive the order. If no one is available, the rider will attempt to contact you. Unclaimed orders may be disposed of and no refund will be issued in such cases.
7. Restaurant Partners
Chowpadi partners with independently owned and operated restaurants. While we work to ensure quality and reliability, Chowpadi does not prepare food and is not responsible for:
- The quality, taste, or presentation of food prepared by restaurant partners
- Allergen information — you should always inform the restaurant of any dietary requirements or allergies
- Restaurant-side errors in order preparation
If you have a complaint about food quality, please contact us and we will liaise with the restaurant on your behalf.
8. Acceptable Use
You agree not to use the Chowpadi platform to:
- Place fraudulent or false orders
- Provide false delivery information
- Abuse, harass, or threaten restaurant staff, riders, or Chowpadi team members
- Attempt to circumvent or manipulate our payment systems
- Use automated tools or bots to interact with our platform without our written consent
- Engage in any activity that disrupts or interferes with the Service
Violation of these terms may result in suspension or permanent termination of your account.
9. Intellectual Property
All content on the Chowpadi platform — including our name, logo, design, text, and software — is the property of Chowpadi Limited and is protected under applicable Nigerian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any Chowpadi content without our prior written consent.
10. Limitation of Liability
To the fullest extent permitted by Nigerian law, Chowpadi shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to:
- Food quality issues caused by restaurant partners
- Delivery delays beyond our reasonable control
- Loss of data or interruption of service
- Unauthorised access to your account resulting from your own actions
Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid for the specific order giving rise to the claim.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will notify you via our website or WhatsApp. The updated Terms will take effect from the date they are published. We encourage you to review these Terms periodically.
12. Governing Law & Disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from or relating to these Terms or your use of the Service shall first be addressed by contacting our support team at support@chowpadi.com. We will make every effort to resolve concerns fairly and promptly.
If a dispute cannot be resolved informally, it shall be referred to the courts of competent jurisdiction in Nigeria.
